The renowned Texas-born Whataburger chain recently announced that it will no longer use its identifiable A-Frame design for its restaurant buildings. LPHS name partner Chris Schwegmann wrote an article published by Texas Lawyer discussing the related trademark and trade dress implications in “Whataburger’s A-Frame a Trademark with All the Fixins.” Schwegmann says: “Although Whataburger appears to lack a federal registration for the iconic ‘A-Frame’ design, it is unlikely competitors will rush to occupy that real estate.”
